Service Level Agreement (SLA)

Guaranteed Monthly Uptime

99.9%

This CaptchaKings Service Level Agreement ("SLA") is a policy governing the use of the CaptchaKings API Service. This SLA applies separately to each account using our services.

1. Service Commitment

CaptchaKings commits to use commercially reasonable efforts to make the CaptchaKings API available with a Monthly Uptime Percentage of at least 99.9% during any monthly billing cycle (the "Service Commitment"). In the event CaptchaKings does not meet the Service Commitment, you will be eligible to receive a Service Credit as described below.

2. Definitions

  • "Monthly Uptime Percentage" is calculated by subtracting from 100% the percentage of minutes during the month in which the CaptchaKings API was in the state of "Unavailable."
  • "Unavailable" means that all of your API requests to the CaptchaKings servers failed (returned 5xx error or timeout) during a 1-minute interval.
  • "Service Credit" is a credit calculated as a percentage of the total charges paid by you for the monthly billing cycle in which the outage occurred.

3. Service Credits

Service Credits are calculated as a percentage of the total charges paid by you for the Service for the monthly billing cycle in which the Service Commitment was not met, in accordance with the schedule below:

Monthly Uptime Percentage Service Credit Percentage
Less than 99.9% but greater than or equal to 99.0% 10% of monthly fee/credits
Less than 99.0% 30% of monthly fee/credits

Note: Service Credits have no cash value and are only applicable as added credits to your account balance for future use.

4. Credit Request and Payment Procedures

To receive a Service Credit, you must submit a claim by opening a support ticket at support@captchakings.com. To be eligible, the credit request must be received by us by the end of the second billing cycle after which the incident occurred and must include:

  • The time and date of each Unavailability incident that you are claiming;
  • The affected API endpoints;
  • Your request logs that document the errors and corroborate your claimed outage.

5. SLA Exclusions

The Service Commitment does not apply to any unavailability, suspension or termination of CaptchaKings performance issues:

  • That result from specific account suspension due to violation of Terms of Service;
  • Caused by factors outside of our reasonable control, including any force majeure event or Internet access or related problems beyond the demarcation point of CaptchaKings;
  • That result from any actions or inactions of you or any third party;
  • That result from your equipment, software or other technology and/or third party equipment, software or other technology.
